A Certificate Holder only wants to make sure you have insurance where an Additional Insured wants to be listed on your policy. Generally, if you have a lease, it requires you to list the landlord as an additional insured on your general liability policy. The theory being; if the landlord is an additional insured your policy and the landlord is pulled into a lawsuit as a result of your negligence, the insurance company will provide a combined defense for both of you. Even if your landlord hasn't asked to be listed as an Additional Insured on your policy, if your lease states that you are to "hold the landlord harmless and indemnity him for any losses, you have already assumed the landlords legal fees. Unless you take the next step and list them on your policy, you are responsible for paying the landlords defense costs. |
